Honesty is the best policy

While it is of course preferable for financial matters to be settled by agreement, it is essential that both parties take independent legal advice. In a recent case the High Court overturned an agreement made between a Husband and Wife as the wife had not had legal advice and the husband had not disclosed considerable assets to his wife.

The Judge said that the parties have a duty to tell each other the truth when striking bargains.
